Resolution vacating a portion of Allegheny Square West in the 22nd Ward, 1st & 6th Council District of the City of Pittsburgh.

Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of Allegheny Square West in the 22nd Ward, 1st & 6th Council District of the City of Pittsburgh, have petitioned the Council of the City of Pittsburgh to enact a resolution for the vacation of same, and
WHEREAS, said petition contains inter-alia, an indemnification of the City from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by any persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore
That vacating a portion of Allegheny Square West, 60' feet wide, between Lot & Block 8-C-134 and 23-R-103; all that certain piece of parcel of land situate in the 22nd Ward, 1st & 6th Council District of the City of Pittsburgh, said area being a portion of Allegheny Square, being more fully bounded and described as follows:
Beginning at a point at the southeast intersection of the western right-of-way of Allegheny Square, 60' wide, and the former northern right-of-way of West Ohio Street, now vacated; Thence along said western right-of-way of Allegheny Square N 14° 02' 38" W, a distance of 118.19' to a point of curvature; Thence by a curve to the left having a radius of 17.00' and an arc distance of 26.67' to a point of tangency, said point also being on the southerly right-of-way of Allegheny Square West, 40' wide; Thence through said Allegheny Square West and said Allegheny Square the following 2 courses and distances:
• N 14° 02' 44" W, a distance of 6.20';
• N 70° 38' 44" E, a distance of 77.30' to a point on the eastern right-of-way of said Allegheny Square; Thence S 14° 02' 44" E, a distance of 175.02'; Thence through said right-of-way of Allegheny Square, S 76° 03' 37" W, a distance of 60.00' to the south east corner of land of the Pittsburgh Children's Museum; Thence along the westerly right-of-way of said Allegheny Square, N 14° 02' 38" W, a distance of 26.37' to the point of beginning, containing 10,511.15 sq.ft., 0.241 acres
That vacating a portion of Allegheny Square West, 60' feet wide, between Lot & Block 8-C-134 and 23-R-103; and also reserving the right of easement of a 12" water line located in West Ohio Avenue, abandoning the 8" waterline, providing the fire hydrant on the 8" water line is relocated to a suitable location to serve all the abutting properties; abandoning the 15" sewerline, providing it not be used as a private sanitary lateral and contingent upon Allegheny Square West being graded, paved and curbed in the 22nd Ward, 1st & 6th Council District of the City of Pittsburgh as described above shall be and the same is hereby vacated.
