Resolution vacating Buffalo Street, Feeney Way 20' Unnamed Way and a 30' Unnamed Way in the 4th Ward, 8th Council District, of the City of Pittsburgh.

WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of Buffalo Street, Feeney Way in the 4th Ward, 8th Council District of the City of Pittsburgh, have petitioned the council of the City of Pittsburgh to enact a resolution for the vacation of same, and
WHEREAS, said petition contains inter-alia, an indemnification of the city from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by ant persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. All that certain lot or parcel of ground situate in the Fourth Ward of the City of Pittsburgh. County of Allegheny and Commonwealth of Pennsylvania, bounded as described as follows, to-wit:
Beginning on the southerly right of way line of Terrace Street, Fifty foot (50') right of way width, at the northwesterly corner of the Wineland Plan Of Lots recorded in the Allegheny County Recorder of Deeds Office in Plat Book Volume 24 at Page 10;
Thence, along said the southerly right of way line, North Thirty-Nine degrees Twenty-One minutes Fifty-Three seconds East (N 39º21'53" E), a distance of Seventy-One and Thirty-Nine hundredths feet (71.39') to the westerly right of way line of Buffalo Street, Thirty-Three (33') right of way width, the True Point of Beginning;
Thence, continuing along said southerly right of way line, North Thirty-Nine degrees Twenty-One minutes Fifty-Three seconds East (N 39º21'53" E), a distance of Thirty-Three and Two hundredths feet (33.02') to the easterly right of way line of Buffalo Street;
Thence, along said easterly right of way line, South Forty-Eight degrees Twenty-Four minutes Twenty-One seconds East (S 48º24'21" E), a distance of One Hundred Forty and Seventeen hundredths feet (140.17') to the northerly right of way line of an unnamed alley Twenty feet (20') in width;
Thence, along said northerly right of way line, North Thirty-Nine degrees Twenty-Eight minutes Fifty-Nine seconds East (N 39º28'59" E), a distance of Eighty-Seven and Sixteen hundredths feet (87.16') to the westerly right of way line of Feeney Way, Twenty (20') feet right of way width;
Thence, along said westerly right of way line, North Fifty-Three degrees Forty-Seven minutes Thirty-Two seconds West (N 53º47'32" W), a distance of One Hundred Forty and Forty-Six hundredths feet (140.46') to the southerly right of way line of Terrace Street;
Thence, along said the southerly right of way line, North Thirty-Nine degrees Twenty-One minutes Fifty-Three seconds East (N 39º21'53" E), a distance of Twenty and Three hundredths feet (20.03') to the easterly right of way line of Feeney Way;
Thence, along said easterly right of way line, South Fifty-Three degrees Forty-Seven minutes Thirty-Two seconds East (S 53º47'32" E), a distance of Three Hundred Thirty-Two and Nine hundredths feet (332.09') to the southerly right of way line of a Thirty feet (30') unnamed street;
Thence, along said southerly right of way line, South Forty-Eight degrees Zero minutes One second West (S 48º00'01" W), a distance of Two Hundred Sixty-Three and Fifteen hundredths feet (263.15') to the westerly line of the Wineland Plan Of Lots

EXCEPTING THEREFROM Lot Nos. 13, 14, 15 and 16 of the Wineland Plan Of Lots, bounded as described as follows, to-wit:
Beginning at the intersection of the southerly right of way line of Terrace Street and the westerly right of way line of Feeney Way;
Thence, along said westerly right of way line, South Fifty-Three degrees Forty-Seven minutes Thirty-Two seconds East (S 53º47'32" E), a distance of One Hundred Sixty and Forty-Nine hundredths feet (160.49') to the intersection of the southerly right of way line of a Twenty Foot (20') unnamed alley and the westerly right of way line of Feeney Way;
Thence, along said westerly right of way line, the following Four (4) courses:
1) South Fifty-Three degrees Forty-Seven minutes Thirty-Two seconds East (S
53º47'32" E), a distance of Ninety-Three and Fifty-Nine hundredths feet

Thirty-Nine and Ninety-Seven hundredths feet (39.97') to the northerly right of
way line of an unnamed street Thirty feet (30') in width;
Thence, along said northerly right of way line, the following Two (2) courses:
1) South Forty-Eight degrees Zero minutes One second West (S 48º00'01" W), a
distance of Forty-Two and Ninety-Six hundredths feet (42.96') and
2) North Eighty-Six degrees Forty-Nine minutes Forty-Four seconds West (N
86º49'44" W), a distance of Forty-Two and Eighty-Nine hundredths feet
(42.89') to the easterly right of way line of Buffalo Street;
Thence, along said easterly right of way line, North Forty-Eight degrees Twenty-Four minutes Twenty-One seconds West (N 48º24'21" W), a distance of Ninety-One and Ninety-Four hundredths feet (91.94') to the southerly right of way line of a Twenty Foot (20') unnamed alley;
Thence, along said southerly right of way line, North Thirty-Nine degrees Twenty-Eight minutes Fifty-Nine seconds East (N 39º28'59" E), a distance of Eighty-Nine and Four hundredths feet (89.04') to the True Point of Beginning.
Containing an area to be vacated as public rights of way of Twenty-Seven Thousand Three Hundred Sixty-Eight square feet (27,368 sq. ft.) or Zero and Six Thousand Two Hundred Eighty-Three ten-thousandths acres (0.6283 ac.)
Being public rights of way dedicated by the Wineland Plan Of Lots recorded in the Allegheny County Recorder of Deeds Office in Plat Book Volume 24 at Page 10 listed as follows, to-wit:
1) Buffalo Street, Thirty-Three feet (33') right of way width,
2) Feeney Way, Twenty feet (20') right of way width, shown on said plan as an
unnamed alley,
3) A Twenty Foot (20') unnamed alley and
4) A Thirty Foot (30') unnamed street, excluding that portion of this street
formerly lying eastward of the easterly right of way line of Feeney Way having
been vacated by the City of Pittsburgh by Ordinance No. 371, approved
November 14, 1963.
Also being those two parcels, portions of Lot No. 16 of the Wineland Plan Of Lots, conveyed on November 14, 1963 by Montefiore Hospital Association of Western Pennsylvania to the City of Pittsburgh as recorded in the Allegheny County Recorder of Deeds Office in Deed Book Volume 4090 at Page 715.
The 6" waterline in Buffalo Street can be abandoned. The 15" sewer line in Buffalo Street can be abandoned and a 15" sewer line in the Unnamed Way and Private property can be abandoned to an existing manhole in Darragh Street, in the 4th Ward, 8th Council District of the City of Pittsburgh as described below shall be and the same is hereby vacated.
