Title
Resolution providing for the extension of an Agreement or Agreements by and between the City of Pittsburgh ("City") and the Pittsburgh Downtown Partnership, a not-for-profit corporation of the Commonwealth of Pennsylvania ("Partnership"), for the purpose of continuing the City's support of the Partnership's effort to construct and operate a wireless communications network in the City's central business district.
Body
WHEREAS, the City, in its central core ("Central Business District" or "CBD") owns, operates, and maintains street lights, street light poles, arms, and other related equipment and land rights beneath the City's street light poles or arms ("Street Lights");
WHEREAS, the City has the ability to control the conditions under which third parties are permitted to contact its Street Lights and street lights attached to street light arms attached to utility poles;
WHEREAS, with the City's support, the Partnership has constructed and operates a wireless telecommunications network (the "System") in the CBD for the purpose of increasing the attractiveness of the CBD for economic development, tourism, and other purposes;
WHEREAS, the Partnership has been granted the right for its selected vendor to attach the Partnership's radios, amplifiers, and transmission components of the System (the "Communications Equipment") to the City's Street Lights, in order to facilitate the wireless communications network;
WHEREAS, the provision of a wireless telecommunications network in the CBD has proved to be successful asset and a worthwhile amenity for the City and its businesses, residents and visitors; and
WHEREAS, the City desires to continue to support the Partnership in its efforts to make the City's central business district more attractive to businesses, residents, and visitors;
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1: The Mayor and the Director and Chief Information Officer of City Information Systems, are hereby authorized to enter into or to extend an Agreement or Agreements with the Pittsburgh Downtown Partnership, approved in form and substance by the Mayor, Director and Chief Information Officer of City Information Systems, and the City Solicitor, for the purpose of supporting the Pittsburgh Downtown Partnership's wireless communications network in the City's central business district for a period of three (3 4) years.
