Title

Resolution providing for the filing of an application or applications by the City of Pittsburgh with the U.S. Department of Labor and/or Commonwealth of Pennsylvania for a grant or grants in connection with the Workforce Investment Act of 1998 (WIA) and/or the Joint Jobs Initiative Program Single Point of Contact (SPOC); Providing for the execution of grant contracts and for the filing of requisitions and other data; providing authorization for the Workforce Investment Board and the City of Pittsburgh to enter into agreements authorized by the Workforce Investment Act of 1998 (WIA) and/or the Joint Jobs Initiative Program Single Point of Contact (SPOC), as amended; Providing for required assurances; providing for execution of payment vouchers and of certification of authorized signatures; providing for a contract or contracts with various agencies/employers for services and programs related to training and employment for Workforce Investment Act of 1998 (WIA) and/or the Joint Jobs Initiative Program Single Point of Contact (SPOC); and providing for the deposit of funds into a bank account. The total amount payable under said agreement or agreements shall not exceed ~~Ten Million Twenty Five Thousand Six Hundred Thirty-Six ($10,025,636.00) Dollars~~ Ten Million One Hundred Three Thousand Nine Hundred Seventeen Dollars ($10,103,917.00) Dollars, chargeable to and payable from the JTPA/WIA Trust Fund, Fund 2300, Account 566000, Organization 109600, Sub-Class 600, Budget Year 2006.

Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1. The Mayor and the City of Pittsburgh is hereby authorized to file an application or

applications in the form required by the U.S. Department of Labor and/or

Commonwealth of Pennsylvania in connection with the Workforce Investment Act of 1998 (WIA) and/or the Joint Jobs Initiative Program Single Point of Contact (SPOC); in order for a grant or grants to be made in connection with the Workforce Investment Act of 1998 (WIA) and/or the Joint Jobs Initiative Program Single Point of Contact (SPOC).

Section 2. In the event that the U.S. Department of Labor and/or the Commonwealth should

approve said application or applications and tender to the City of Pittsburgh a grant

contract or contracts in connection therewith, the Mayor and the City of Pittsburgh, on behalf of the City, is hereby authorized to execute said contract or contracts. Said contract or contracts shall be in a form approved by the City Solicitor and shall contain such terms and conditions as said Solicitor may require.

Section 3. The Mayor of the City of Pittsburgh, in accordance with the requirements of the

Workforce Investment Act of 1998 (WIA) and/or the Joint Jobs Initiative Program

Single Point of Contact (SPOC), shall appoint nominated individuals to the Workforce Investment Board. Such individuals shall be nominated in accordance with the requirements of the Workforce Investment Act of 1998 (WIA) and/or the Joint Jobs Initiative Program Single Point of Contact (SPOC).

Section 4. The City of Pittsburgh, as the Grant Recipient, will assume full responsibility for

all funds which may be provided under WIA and/or SPOC. The City of Pittsburgh assures that said funds will be used in an economical and efficient manner in carrying out the WIA and/or SPOC. The City of Pittsburgh will provide the necessary non-federal share of the cost of the plans.

Section 5. The Workforce Investment Act of 1998 (WIA) and/or the Joint Jobs Initiative

Program Single Point of Contact (SPOC), as set fourth by mutual approval of the Mayor of the City of Pittsburgh and the Workforce Investment Board, are hereby approved.

Section 6. The City of Pittsburgh hereby assures its full compliance with the implementation

of the following:

1. Regulation of the United States Department of Labor effectuating Title VI of the Civil Rights Act of 1964 and any amendments thereto;
1. Applicable laws relating to equal employment opportunity;
1. Federal labor standards imposed under Title VII of the Housing Act of 1961, as amended, where applicable;
1. Age Discrimination Act of 1975;
1. Section 504 of the Rehabilitation Act of 1973;
1. Title IX of the Educational Amendments of 1972 on the basis of sex;
1. Americans with Disabilities Act;
1. Other certifications and/or assurances not related to expenditures as may be required by the Grantor and approved by the City Solicitor.

Section 7. The Director of the Department of Personnel and Civil Service Commission is

hereby designated as the authorized representative of the City of Pittsburgh, as Grant Recipient and Plan Administrator, for the purpose of furnishing to the Commonwealth of Pennsylvania such information, data and documents pertaining to said application or applications and project or projects as may be required and to take such other actions as may be necessary to enable the City of Pittsburgh to qualify as a Workforce Investment Area and grant recipient and plan administrator for said grant or grants.

Section 8. Any two of the following four officers are hereby authorized to execute payment

vouchers on grant contracts with the Commonwealth of Pennsylvania in connection with said project or projects:

Mayor

Controller

Director of the Department of Finance

Director of the Department of Personnel and Civil Service Commission

Section 9. The City Clerk is hereby authorized and directed to certify the authenticity

of the signature of the officers designated in the preceding section, in connection with the Workforce Investment Act of 1998 (WIA) and/or the Joint Jobs Initiative Program Single Point of Contact (SPOC).

Section 10. The City Treasurer is hereby authorized and directed to deposit the funds referred

in this Resolution into a bank account.

Section 11. The Mayor and the Director of the Department of Personnel and Civil Service

Commission, on behalf of the City of Pittsburgh, are hereby authorized to enter into an agreement or agreements with private-for-profit businesses, non-profit organizations and various agencies to provide various services including, but not limited to coordination, recruitment, outreach, assessment, support services, pre-vocational and/or vocational training, job search assistance, job counseling, remedial education, basic skills training, institutional skills training, on-the-job training, school-to-work transition activities, welfare-to-work, literacy training, work experience, vocational exploration, job development, pre-apprenticeship programs, disseminating information on program activities, CareerLink Centers support follow-up services, program evaluations, and financial and personal counseling, for qualified adult dislocated workers and youth and effectuation of grievance procedures and to provide payment for the costs thereof in order to support, implement, and administer the Workforce Investment Act of 1998 (WIA) and/or the Joint Jobs Initiative Program Single Point of Contact (SPOC).

Said agreement or agreements shall be in a form approved by the City Solicitor and shall contain such terms and conditions as said Solicitor may require.
