Title

Resolution granting to Equitable Gas Company, a division of Equitable Resources Inc., a permanent utility easement and the privilege and license to install, use, operate, maintain, repair, renew and finally remove a 20 inch Steel Gas line across the City of Pittsburgh property designated as Block 82-H-Lot No. 1, located parallel with Washington Boulevard on the edge of Highland Park from One Wild Place eastward to the Highland Park Bridge in the 11th Ward.

 

Body

Whereas:  The City of Pittsburgh owns certain property adjacent to Washington

Boulevard between One Wild Place and the Highland Park Bridge, being Block 82-H-Lot 1 in the 11th Ward, along the edge of Highland Park.

 

Whereas:  The Equitable Gas Company, a division of Equitable Resources Inc.,

Desires to install a new pipeline that will serve the northeast section of the City of Pittsburgh and needs permanent access across the above-mentioned City property for its 20 inch steel gas main line.

 

Be it resolved by the Council of the City of Pittsburgh as follows

 

Section 1.  The Mayor and the Directors of the Department of Finance or of the Department of Parks and Recreation, on behalf of the City of Pittsburgh, are hereby authorized to execute an agreement granting to the Equitable Gas Company, a division of Equitable Resources Inc. ("Equitable Gas Co.") an easement across City of Pittsburgh property Block 92-H, Lot 1, in the 11th Ward.  Said agreement shall be in the form approved by the City Solicitor and shall contain such terms and conditions for the protection of the City of Pittsburgh and Highland Park as the Solicitor may require.

 

The easement granted to Equitable Gas Co. for the 20 inch steel gas main line is shown on Equitable Gas Co.'s Survey of Easement Map and consists of a standard 20-foot wide permanent easement and a 20 foot wide temporary construction easement.  The alignment is parallel with the southern line of Washington Boulevard and extends from One Wild Place eastward to the Highland Park Bridge, along the edge of Highland Park.  The total length of the easements is 1510.66 feet, more or less.

 

Section 2.  The privilege and easements hereby granted shall be subject to the following terms and conditions as shall be more specifically set forth in the agreement authorized by this Resolution:

 

a)                     Equitable Gas Co. shall bear the full cost and expense of the installation, construction, use and maintenance of said permanent utility easement and temporary construction easement.

 

b)                     Equitable Gas Co. shall indemnify, save harmless, and defend the City of Pittsburgh from any and all damages or claims for damages, whether to property or to person, arising by reason of the construction, installation, maintenance or use of the gas line.

 

c)                     Equitable Gas Co. shall cause minimum disruption to the natural environment of the park when installing the gas line.

 

d)                     Equitable Gas Co. shall restore the easement areas in cooperation with and in accordance with the requirements of the Department of Parks and Recreation Development Plans for this area.

 

e)                     Equitable Gas Co. may remove two trees, specifically identified by the City Forester, and shall replace up to ten trees, as specifically required by the City Forester, and shall reimburse the City for any damage to growing shrubs, trees, grass or fences caused by the entry on to the land for the installation, construction, maintenance or use of the gas line.

 

f)                     Equitable Gas Co. shall pay to the City Eight Hundred Dollars ($800.00), a one time fee for this permanent utility easement, due on the date of the signing of this agreement.
