Title

Resolution supplementing Resolution No. 408 of 2004, effective August 20, 2004, and authorizing the Director of the Department of Public Works or the Director of the Department of Finance to enter into a license agreement or agreements with the Port of Pittsburgh Commission and/or with the owners and/or operators of a water taxi/shuttle service allowing the docking of water taxi/shuttle boats in City parks at the City-owned wharves or docks at the Sixth Street Bridge on the southern shore of the Allegheny River and at the David L. Lawrence Convention Center.

 

Body

WHEREAS, the City owns certain riparian rights  on the southern shore of the Allegheny River at the Sixth Street Bridge and at the David L. Lawrence Convention Center; and

 

WHEREAS, the City and the Port of Pittsburgh Commission, a body corporate and politic, and instrumentality of the Commonwealth, have determined that the aforesaid docks or wharves are suitable for the docking of a  water taxi/shuttle service operating between certain points within the City; and

 

WHEREAS, the City is willing to permit the  water taxi/shuttle boats to dock on a regular basis at the southern shore of the Allegheny River at the Sixth Street Bridge and at the David L. Lawrence Convention Center  for the purpose of loading and unloading passengers; and

 

WHEREAS, by Resolution No. 408 of 2004, effective August 20, 2004, City Council authorized the Director of the Department of Finance to enter into a license agreement or agreements with the Port of Pittsburgh Commission and/or with the owners and/or operators of a water taxi service allowing the docking of water taxi boats at the City-owned wharves or docks at the Sixth Street bridge on the southern shore of the Allegheny River, at the David L. Lawrence Convention Center and at the Monongahela Wharf; and

 

WHEREAS, by the aforesaid Resolution City Council allowed such license to be granted for the period August 1, 2004 through October 31, 2004, and renewed for a further period from May 1, 2005, through October 31, 2005, if the Director of the Department of Finance and the Port of Pittsburgh Commission found such water taxi/shuttle service to continue to be in the best interests of the City; and

 

WHEREAS, the Directors of the Departments of Finance and Public Works and the Port of Pittsburgh Commission continue to find such water taxi/shuttle service to be in the best interests of the City:

 

Be it resolved that the Council of the City of Pittsburgh hereby enacts as follows:

 

Section 1.                     Resolution No. 408 of 2004, effective August 20, 2004, is supplemented in order to grant final approval to the Director of the Department of Finance, as the City Wharf Master, or the Director of the Department of Public Works,  who has jurisdiction over City Parks, to enter into a revocable, non-exclusive license agreement or agreements with the Port of Pittsburgh Commission, and/or a duly authorized owner/operator of a water taxi/shuttle service, permitting it or them to dock on the southern shore of the Allegheny River at the Sixth Street Bridge and at the David L. Lawrence Convention Center for the purpose of loading, transporting and unloading passengers for a reasonable fee.

 

Section 2.                     The license or licenses shall be issued in a form satisfactory to the City Solicitor and shall specify the precise location of the docking at the aforesaid locations.

 

Section 3.                     The license shall be granted for the period May 27, 2006 through October 31, 2006, renewable annually for subsequent boating seasons through 2010 with the specific days and hours of operation to be decided by P.P.C., provided P.P.C. notifies the CITY in writing by April 30 of each year of its intention to renew, and supplies revised Exhibits “A” and “C” to the CITY.

 

Section 4.                     Any license issued pursuant to this resolution is not intended to replace any permit or other authorization required under federal or state law for the operation of taxi/shuttle services on navigable waters.
