Title
An Ordinance amending the Pittsburgh Code, Title One: Administration: Article XI, Personnel, Chapter 192:Pensions, by creating a thirty day time frame for eligibility of benefits for certain pension members
Body
Whereas, by amendments to the Pittsburgh Code, Title One: Administration: Article XI, Personnel, Chapter 192:Pensions, the City made certain changes providing for the enhancement of the Municipal Pension Plan under certain conditions; and
 
Whereas, it was the express intention of the Administration in submitting such legislation to make available certain enhancement solely to members of the Municipal Plan who were employees of the City of Pittsburgh as of January 1, 2002; and
 
Whereas, it is understood that members who had left the employ of the City prior to January 1, 2002 are not entitled to the enhanced benefits: and
 
Whereas, the members of the Municipal Pension Plan who are not employees includes the following categories of people:
 
1.      former employees who terminated service and currently receive
the pension for which they were eligible at the time of their
termination; and,
 
2.      former employees who have achieved or purchased  the
minimum age and years of service required to become eligible for a
pension  but have elected to defer receipt of a pension; and,
 
3.      former employees who have not yet achieved or purchased the
minimum age and years of service required to become eligible for a
pension but have made agreements to purchase the needed age and
time; and,
 
4.      former employees who are members of the fund but have not
yet made an election to defer receipt of a pension or do not have the
needed age and time to purchase a pension.
 
Whereas, Council would like to extend enhancement which eliminates the social security offset to the second and  third categories of people just described: former employees who have not yet achieved or purchased the minimum age and years of service but who currently are making such payments; and
 
Whereas Council is willing to extend the benefit to such employees;
 
Be it resolved that the Council of the City of Pittsburgh hereby enacts as follows:
 
Section 1.  The Pittsburgh Code, Tittle One: Administrative: Article XI, Personnel, Chapter 192: Section 192.26 Pensions Allowance is hereby amended  to add the following subsection 192.26 (h)
      
 
(h)      Members of either Municipal Benefit Plan No 1 or No 2 who were city employees who terminated employment with the city before January 1, 2002 may irrevocably elect to have their pensions calculated without the social security offset currently applicable to them and either but only if they make such election within thirty days of the final passage of this legislation and they are:
 
(1)      Former employees that did not at the time of termination
have sufficient years of service nor achieve age 50 and are
currently making payments sufficient to purchase time and age
and, or
 
(2)      Former employees who achieved the requisite time and age
but have not yet taken a pension and, or
 
(3)      Members of the fund who have made no election to date.
 
NOTE: I do hereby certify that the foregoing Ordinance duly engrossed and certified, was delivered by me to the Mayor for his approval of disapproval and that the Mayor failed to approve or disapprove the same, whereupon it became law without his approval, under the provisons of the Act of the Assembly in such case made and provided.
