Title

Resolution requesting the approval of an inter-municipal transfer of a restaurant liquor license, License No. TR-07577, from A & W Restaurant and Lounge, Inc, 102 Brownsville Road (Mt Oliver Borough) Pittsburgh, PA 15210-2114 to Robert Matrascia, 644 Perrilynn Street, Pittsburgh, PA 15226 and Rose Desensi Caruso, 277 Pioneer Avenue, Pittsburgh, PA 15226 for Pasta Too Pizzeria Restaurant, Inc, located at 1106 Federal Street, Pittsburgh, PA 15212, pursuant to amended Pennsylvania Liquor Code, §4-461.

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.  The Council of the City of Pittsburgh hereby endorses the request for approval of an inter-municipal transfer of a restaurant liquor license, License No. TR-07577, with request for conditions outlined in Section 5, from A & W Restaurant and Lounge, Inc, 102 Brownsville Road (Mt Oliver Borough) Pittsburgh, PA 15210-2114 to Robert Matrascia, 644 Perrilynn Street, Pittsburgh, PA 15226 and Rose Desensi Caruso, 277 Pioneer Avenue, Pittsburgh, PA 15226 for Pasta Too Pizzeria Restaurant, Inc, located at 1106 Federal Street, Pittsburgh, PA 15212, pursuant to amended Pennsylvania Liquor Code, §4-461.

 

SECTION 2.  Request for Approval

 

Robert Matrascia, which has a mailing address of 644 Perrilynn Street, Pittsburgh, PA 15226 and Rose Desensi Caruso, 277 Pioneer Avenue, Pittsburgh, PA 15226, submitted a request for approval of an inter-municipal transfer of a restaurant liquor license, License No.TR-7577 , which is currently registered to A & W Restaurant and Lounge, Inc., 102 Brownsville Road, Pittsburgh, PA 15210-2114, desires to place a restaurant liquor license into a premises known as Pasta Too Pizzeria Restaurant, Inc located at 1106 Federal Street, Pittsburgh, PA 15212. The proposed interior of the premises is a two-story building with the restaurant on the first floor.

 

SECTION 3 Public Hearing

 

                     City Council shall set a date for Public Hearing for the purpose of receiving comments and recommendations of interested individuals residing in the City of Pittsburgh concerning Robert Matracia and Rose Desensi Caruso's intent to the above liquor license.

 

 

 

 

 

 

SECTION 4.  Approval or Denial of Request

 

                     After the Public Hearing and within 45 days of the introduction of this Resolution, City Council shall render a decision to approve or disapprove of Robert Matracia and Rose Desensi's request for inter-municipal transfer of a restaurant liquor license.  City Council must approve Robert Matracia and Rose Desensi Caruso's request unless it finds that approval would adversely affect the welfare, health, peace and morals of the City of Pittsburgh or its residents.

 

SECTION 5.  Notwithstanding the approval of License No. TR-07577 , City Council wishes to go on record with the PA Liquor Control Board in support of certain conditions being placed on the license.  Specifically, beer, malt liquor and wine may be served for consumption on the premise. No take out beer, wine or malt liquor may be sold for take out service.
