Title

Resolution Amending Resolution No. 126, effective March 28, 2001, entitled, "A resolution providing for an Agreement with Byrd R. Brown Law Offices for legal representation as the Solicitor of the Pittsburgh Commission on Human Relations in 200" by decreasing the amount from $23,000.00 to $2,343.85.

 

Body

WHEREAS, the Mayor and the Director of the Commission on Human Relations, on behalf of the City of Pittsburgh, were duly authorized to enter into an Agreement, in form approved by the City Solicitor, with Byrd R. Brown Law Offices to provide legal services as the Solicitor for the Pittsburgh Commission on Human Relations, at a cost not to exceed Twenty Three Thousand Dollars ($23,000); and

 

WHEREAS, said Agreement was approved by City Council, continued in process and was executed by all parties, except the Controller, when Byrd R. Brown died suddenly on May 3, 2001; and,

 

WHEREAS, the sudden death of Byrd resulted in the immediate closure of the Byrd R. Brown Law Offices, said Agreement was not finalized; and

 

WHEREAS, professional legal services were provided to the Commission by the Byrd R. Brown Law Offices prior to the death of Byrd R. Brown, and such legal services were properly billed in the amount of Two Thousand Three Hundred Forty-three Dollars and Eighty-five Cents ($2,343.85);

 

Be it resolved that the Council of the City of Pittsburgh hereby enacts as follows:

 

Section 1.                     Resolution No. 126, effective March 28, 2001 entitled, " A resolution providing for an Agreement with Byrd R. Brown Law Offices for legal representation as the Solicitor of the Pittsburgh Commission on Human /Relations in 2001 and providing for the payment of the cost thereof," is hereby amended to reduce the amount of the contract with  Byrd R. Brown Law Offices from Twenty-three Thousand Dollars to Two Thousand Three Hundred Forty-three Dollars and Eighty Five Cents (($2,343.85); and,

 

Further, that the City Controller is hereby authorized and directed to issue a warrant in the amount of Two Thousand Three Hundred Forty-three Dollars and eighty–five cents ($2,343.85) to the estate of Byrd R. Brown to satisfy an outstanding invoice fro legal services properly rendered and duly billed prior to the death of Byrd R. Brown.  Such payment will be chargeable to and payable from Code Account 1035, Miscellaneous Services (Index Code 103507), Commission on Human Relations, Org. 105000, Fund 1000, Sub-Class 150, Account 526145, Budget Year 2001.
