Resolution vacating a Traffic Island east of Commonwealth Place on Liberty Avenue in the 2nd Ward, 6th Council District of the City of Pittsburgh.

 

Body

WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that all owners of the property fronting or abutting on the line of this Traffic Island in the 2nd Ward, 6th Council District of the City of Pittsburgh, have petitioned the Council of the City of Pittsburgh to enact a resolution for the vacation of same, and

 

WHEREAS, said petition contains inter-alia, an indemnification of the City from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by any persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore

 

Be it resolved that the Council of the City of Pittsburgh hereby enacts as follows:

 

Section 1.                     That vacating a Traffic Island on Liberty Avenue:

 

                     Beginning at a point on the Northerly line of said Island at the point of Tangent Noted as station 12 + 68.483 as shown on plans on file at City of Pittsburgh Department of Engineering & Construction in case number 11, pocket number 16, folder number 2 accession number 4320 & 4321; thence along said line N. 680 33' 09" E.  A distance of 94.00' to a point of curve; said point of curb having a station of 11 + 74.483 on said plan; thence by an arc, curving to the right, having a radius of 27.00', for an arc distance of 84.823' to a point of tangent; thence S. 680 33' 09" W., a distance of 94.00' to a point of curve; thence by an arc, curving to the right, having a radius of 27.00' for an arc distance of 84.823' to a point at the place of beginning.

 

Prior to any construction, design approval must be obtained from the Department of Engineering and Construction and the Pittsburgh Water and Sewer Authority.  The City of Pittsburgh retains all revisionary rights to this property.

 

                     Also reserving the right of easement of 15" and 18" sewer lines located therein, in the 2nd  Ward, 6th  Council District of the City of Pittsburgh is hereby vacated.
