Title

Resolution vacating a portion of Musgrave Street and accepting the dedication of relocated Musgrave Street in the 15th Ward, 5th Council District, of the City of Pittsburgh.

 

Body

Whereas, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of Musgrave Street in the 15th Ward, 5th Council District of the City of Pittsburgh, have petitioned the council of the City of Pittsburgh to enact a resolution for the vacation of same, and

 

Whereas, said petition contains inter-alia, an indemnification of the city from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by and persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.  That vacating a portion of Musgrave Street as described: Beginning at a point on the Northern line of Musgrave Street said point being the Southwest corner of Lot No. 17 in the D.R. Deeley's Plan of Lots; thence along the Northern line of Musgrave Street North 71° 17' 30” East a distance of 200.0 feet to its terminus at the intersection with a 20.0 feet wide Unnamed Way; thence Southeasterly along the terminus of Musgrave Street South 16° 50' 30” East a distance of 40.02 feet to a point on the Southerly line of Musgrave Street said point being the Northeast corner of Lot No. 15 in said D. R. Deeley's Plan of Lots; thence Westwardly along the Southern line of Musgrave Street South 71° 17' 30” West a distance of 165.76 feet to a point; thence Northwestwardly across Musgrave Street North 58° 10' 39” West a distance of 51.80 feet to a point on the Northern line of Musgrave Street at the PLACE OF BEGINNING.  Containing 7, 315 square feet of area.

 

Accepting the dedication for relocated Musgrave Street as described:  Beginning at a point on the Southerly line of Musgrave Street, at a point on the Northwest corner of lot No. 7 in the D.R. Deeley's Plan of lots; thence by a line across lots 7 through 14 in said Plan South 77° 35' 37” East a distance of 232.22 feet to a point on the Southeast corner of lot No.14 being the Northern line of a 20 foot wide Unnamed Way; thence Eastwardly on said Northern line also being the Southern line of lot No. 15 in said Plan of lots North 71° 17' 30” East a distance of 21.09 feet to the Southeast corner of lot No. 15 and a 20 foot wide Unnamed Way; thence Northwardly along this Unnamed Way being the Eastern line of Lot No 15 North 16° 50' 30” west a distance of 21.89 feet to a point on said line; thence Northwesterly across Plan lots  No. 15 to No. 9 in said Plan North 77° 35' 37” West a distance of 189.88 feet to a point on the Southern line of Musgrave Street and the Northern line of lot No. 9 ; thence along said Southern line of Musgrave Street Westwardly South 71° 17' 30” West a distance of 58.05 feet to a point at the PLACE OF BEGINNING.  Containing 6, 562 square feet of area.

 

And also reserving he right of easement of a 15” sewer line and a 6” water line located therein, in the 15th Ward, 5th Council District of the City of Pittsburgh as described above shall be and the same is hereby vacated.
