Resolution vacating a portion of King Avenue from Cordova Road to it's terminus in the 11th Ward, 7th Council District, of the City of Pittsburgh.
 
Body
WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of King Avenue in the 11th Ward, 7th Council District of the City of Pittsburgh, have petitioned the council of the City of Pittsburgh to enact a resolution for the vacation of same, and
 
WHEREAS, said petition contains inter-alia, an indemnification of the city from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by and persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore
 
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.  That vacating a portion of King Avenue, 50 feet wide from Cordova Road to its terminus:
A.      Western Portion to parcel 82-B-230, adjacent owner
 
Beginning at a point on the Southeast corner of parcel 82-B-230 in the 11th Ward said point also being the Southeast corner of Lot No. 51 in the Negley Orchard Plan of Lots, Plan Book Volume 27, Pages 116 and 117, and the corner intersection of Cordova Road, 30 feet wide, and King Avenue, 50 feet wide; thence extending Eastward into King Avenue South 70º 59' East a distance of 40.0 feet to a point in King Avenue; thence North 19º01' East a distance of 121.94 feet to a point at the terminus of King Avenue being the property line of City of Pittsburgh parcel 82-H-1; thence North 63º 00' 50" West along said terminus line a distance of 40.43 feet to a point at the Northeast corner of Lot No. 51 previously mentioned; thence along the Eastern lot line of Lot No, 51 South 19º 01' West a distance of 127.55 feet to a point at the place of beginning. Containing 4,990 square feet of area to revert to parcel 82-B-230.
 
B.      Eastern portion to parcel 82-G-50, City of Pittsburgh, Park
 
Beginning at a point on the Southeast corner of parcel 82-B-230 in the 11th Ward, said point also being the Southeast corner of Lot No. 51 in the Negley Orchard Plan of Lots, Plan Book Volume 27, Pages 116 and 117, and the corner intersection of Cordova road, 30 feet wide, and King Avenue, 50 feet wide; thence extending Eastward into King Avenue South 70º 59' East a distance of 40.0 feet to a point on King Avenue at the true place of beginning; thence continuing South 70º 59' East a distance of 10.0 feet to a point on the Eastern line of King Avenue and the lot line of City of Pittsburgh parcel 82-G-50; thence continuing along this lot line North 19º 01' East a distance of 120.55 feet to a point at the terminus of King Avenue being the property line of City of Pittsburgh parcel 82-H-1; thence North 63º 00'50" West along said terminus line a distance of 10.06 feet to a point; thence Southwardly parallel with the eastern line of King Avenue South 19º 01' West a distance of 121.94 feet to a point at the true place of beginning.  Containing 1,212 square feet of area to revert to City of Pittsburgh parcel 82-G-50.
 
And also reserving the right of easement of an 8" water line located therein, in the 11th Ward, 7th Council District of the City of Pittsburgh as described below shall be and the same is hereby vacated.
 
Maintenance terms per letter of understanding signed by the property owner at 1375 Cordova Road (82-B-230) and the Director of the Department of Parks and Recreation dated November 2, 2006.
