Resolution vacating portions of North Shore Drive, Stadium Circle Drive, and the old overhead Pedestrian Walkway in the 22nd Ward, 6th Council District of the City of Pittsburgh

Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.  WHEREAS, it appears by petition and affidavit on the file in the Office of the City Clerk that all Owners of the property fronting or abutting on the southerly and northerly line of North Shore Drive (60' width) west of the Avenue of the Pirates (Parcel 1) in the 22nd Ward, 6th Council District of the City of Pittsburgh, have petitioned the Council of the City of Pittsburgh to enact a resolution for the vacation of the same, and
 
WHEREAS, it appears by petition and affidavit on the file in the Office of the City Clerk that all Owners of the property fronting or abutting on the southerly and northerly line of North Shore Drive (60' width) for a distance south of West General Robinson Street (Parcel 2) in the 22nd Ward, 6th Council District of the City of Pittsburgh, have petitioned the Council of the City of Pittsburgh to enact a resolution for the vacation of the same, and
 
WHEREAS, it appears by petition and affidavit on the file in the Office of the City Clerk that all Owners of the property fronting or abutting on the southerly and northerly line of Stadium Circle Drive (40' width) for a distance north of West General Robinson Street (Parcel 3) in the 22nd Ward, 6th Council District of the City of Pittsburgh, have petitioned the Council of the City of Pittsburgh to enact a resolution for the vacation of the same, and
 
WHEREAS, it appears by petition and affidavit on the file in the Office of the City Clerk that all Owners of the property fronting or abutting on the easterly and westerly line of Stadium Circle Drive (40' width) for a distance south of West General Robinson Street (Parcel 4) in the 22nd Ward, 6th Council District of the City of Pittsburgh, have petitioned the Council of the City of Pittsburgh to enact a resolution for the vacation of the same, and

WHEREAS, it appears by petition and affidavit on the file in the Office of the City Clerk that all Owners of the property fronting or abutting on the southerly and northerly line of Overhead Pedestrian Walkway (42' width) for a distance south of West General Robinson Street (Parcel 7) in the 22nd Ward, 6th Council District of the City of Pittsburgh, have petitioned the Council of the City of Pittsburgh to enact a resolution for the vacation of the same, and
 
WHEREAS, said petition contains inter-alia, an indemnification of the City from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by any persons whatsoever, abutting or non-abutting, for or by reason of said vacation: therefore
 
Parcel 1
 
Section 1.      That vacating a portion of North Shore Drive, beginning at a point at the intersection of the westerly Legal right-of-way line of (Stadium Drive East) now Avenue of the Pirates.   Coordinate N 104728.5763, E 97805.9246 of said point being 35.00 feet left of Avenue of the Pirates Centerline, Station 303+82.61 feet; thence along said R/W line South 13°28'09" East for a distance of 10.55' to a point of tangency; thence
 
continuing along said R/W line by a line curving to the right having a radius of 15.00 feet, an Arc distance 14.42 feet  to a point of tangency, the chord of said line being South 14°04'41" West a distance of 13.87 feet;  thence
 
by a line curving to the left having a radius of 80.49 feet, an Arc distance of 111.42 feet to a point on the Southerly R/W line of North Shore Drive, the chord of said line being South 01°58'12" West a distance of 102.73 feet;  thence

by a line curving to the left having a radius of 144.00 feet, an Arc distance of 115.97 feet to a point  of tangency on the northerly R/W line of North Shore Drive, the chord of said line being North 53°55'43" East a distance of 112.86 feet;  thence
 
by a line curving to the left having a radius of 115.00 feet, an Arc distance of 18.68 feet to the point of beginning, the chord of said line being North 03°09'09" East a distance of 18.66 feet.
 
Containing an area of 41,878 square feet or 0.961 acres.
 
But specifically reserving the right of easement for the Pittsburgh Water and Sewer Authority - in North Shore Drive there is a 12" water line. This 12" water line in North Shore Drive should be retained.
 
In North Shore Drive there is a 30" sewer line.  This 30" sewer line in North Shore Drive should be retained.
 
In North Shore Drive there is a 48" sewer line.  This 48" sewer line in North Shore Drive should be retained.
 
In North Shore Drive (approximately 150' from Fort Duquesne Bridge) there is a 36" sewer line.  This 36" sewer line should be retained.
 
In North Shore Drive there is a 54" x 72" sewer line.  This 54" x 72" sewer line should be retained.
 
Parcel 2
 
Section 2.      That vacating a portion of North Shore Drive, beginning at a point at the intersection of the southerly Legal right-of-way line of new North Shore Drive.   Coordinate N 104266.2129,  E 95910.6913 of said point being 35.99 feet right of new North Shore Drive Survey & R/W Centerline, Station 283+35.78 feet; thence
 
 
 
along the southerly R/W line of new North Shore Drive (crossing old North Shore Drive) North 76°07'30" East for a distance of 15.46 feet to a point of tangency;   thence
