Ordinance amending the Pittsburgh Code, Title Six-Conduct, Article I, Regulated Rights and Actions, by repealing Chapter 603 - Parades and Crowds in its entirety.

Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.  That the Pittsburgh Code, Title Six-Conduct, Article I, Regulated Rights and Actions, Chapter 603, Parades and Crowds, is repealed in its entirety, as follows:

601.01 DEFINITIONS
 
As used in this Chapter, certain terms are defined as follows:
 
(a)      LARGE CROWDS. The number of persons as are solely determined by either the Superintendent of Police to require necessary police protection or the Chief of the Bureau of Emergency Medical Services to require paramedic protection.
 
(b)      UNIFORMED and NONUNIFORMED POLICE. Include members of the City Police Department or any reputable private security company or service which is duly licensed by the Commonwealth.
 
(c)      UNIFORMED PARAMEDICS. Employees of the city, Department of Public Safety Bureau of Emergency Medical Services.  (Am. Ord. 13-1994, eff. 7-22-94)
 
§ 603.02  CROWDS REQUIRING POLICE OR PARAMEDIC PROTECTION.
 
(a)      Where the presence of uniformed or nonuniformed police officers at events attracting large crowds is deemed a necessary protection to the public by the Superintendent of Police, he or she shall have full authority to require the person or organization conducting such event to employ the number of uniformed or nonuniformed police officers as may be designated by him or her.
 
(b)      Where the presence of Emergency Medical Services is necessary, requested, or utilized, the Chief or his/her designate shall have full authority to require a person, organization, or promoter conducting such event to employ such number of uniformed paramedics as may be designated by the Chief or his/her designate at the rates determined for extra work under the terms and conditions of the collective bargaining agreement in existence between the City and the Fraternal Association of Professional Paramedics.

§ 603.03  PARADE PERMIT AND CONTROL.
 
(a)      Permits required. No person shall conduct or participate in any parade, procession, assemblage or meeting occupying, marching or assembling upon any street, wharf or public square of the city, to the interference, interruption or exclusion of other persons in their legal right to the use thereof, without a permit being issued therefor by the Superintendent of Police. Written application shall be made to the Superintendent not less than twenty-four (24) hours in advance of the time intended to commence such event stating the character and object, time, place and route of the event along with the names of the persons in charge or responsible for control.
 
(b)      Issuance and control. The Police Superintendent shall have exclusive power to designate by permit the time and place for commencing and ending the event along with the route of march, places of assembly or dispersal and public property to be occupied. The persons in charge or responsible for control of the event shall be responsible for the violation of any provisions or limitations designated in the permit. The Superintendent shall furnish the escort as may be necessary to protect persons and property and to maintain the public peace and good order of the city.  (Ord. 55-1991, eff. 12-31-91)
 
(c)      Permit fee.
 
(1)      Where a parade follows the standard parade route from the Civic Arena to Point State Park, the permit fee shall be two hundred ninety dollars ($290.00). When the permit is issued for a day that is a police holiday the fee shall be five hundred seventy-nine dollars ($579.00).
(2)      Where a parade takes place in the Central Business District on other than the standard parade route and necessitates the closing of streets, the permit fee shall be based on the cost to the City of providing police coverage and traffic control, and will take into consideration the number of intersections, number of police required, and length of time, but in an amount not to exceed the approved fees stated in subsection (c)(1) hereof.
(3)      Where a parade does not necessitate the closing of streets in the Central Business District or occurs outside of the Central Business District, the fee shall be sixty dollars ($60.00). All processions, assemblies or marches shall be assessed sixteen dollars ($16.00) pursuant to § 107.02 of the Pittsburgh Code.
(4)      An applicant who is indigent or otherwise without financial resources to pay the permit fee may apply for a waiver. The waiver shall be granted upon affidavit and satisfactory supporting financial information presented at the time of the application. (Ord. 11-1993, eff. 5-19-93) ]
