Title

Resolution amending Resolution 468 of 2018, approved July 2nd, 2018, “authorizing the Mayor and the Director of the Department of Mobility and Infrastructure, on behalf of the City of Pittsburgh (“City”), to enter into Agreements with the Sports & Exhibition Authority of Pittsburgh and Allegheny County (the “SEA”), in order to disperse certain funds to City for and facilitate construction of the I-579 Cap Project”; in order to provide authorizations to acquire certain additional funding to facilitate construction of the I-579 Cap Project.

 

Body

WHEREAS, the City wants to participate in the construction and obtain ownership of a cover over a depressed section of State Route (SR) 579 (a/k/a Interstate 579) between Centre Avenue and Bigelow Boulevard and open green space and certain other improvements over such cover and adjacent property (the “I-579 Cap Project”); and

 

WHEREAS, the SEA and City will collaborate on multiple responsibilities of the I-579 construction project; and

 

WHEREAS, SEA is obtaining funding from multiple sources including a Pennsylvania Department of Community and Economic Development (“DCED”) Multi-Model Grant, Redevelopment Assistance Capital Program (“RACP”) Grant, Pennsylvania Department of Transportation (“PennDOT”) Multi-Model Grant and a Pennsylvania Department of Conservation and Natural Resources (“DCNR”) C2P2 Grant, which will each require separate agreements to facilitate grant fund dispersal; and

 

WHEREAS, the City now wishes to enter into Agreements with the SEA in order to establish certain responsibilities between the parties for the construction of the I-579 Cap Project and to facilitate dispersal of certain funds obtained by the SEA.

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.  Resolution 468 of 2018, approved July 2nd, 2018, “authorizing the Mayor and the Director of the Department of Mobility and Infrastructure, on behalf of the City of Pittsburgh (“City”), to enter into Agreements with the Sports & Exhibition Authority of Pittsburgh and Allegheny County (the “SEA”), in order to disperse certain funds to City for and facilitate construction of the I-579 Cap Project”; is hereby amended as follows:

 

Section 1. The Mayor and Director of the Department of Mobility and Infrastructure, on behalf of the City, are now authorized to enter into a Cooperation Agreement with the Sports & Exhibition Authority of Pittsburgh and Allegheny County in order to establish certain responsibilities of both parties with respect to the I-579 Cap Project.

 

Section 2. The Mayor and Director of the Department of Mobility and Infrastructure, on behalf of the City, are further authorized to enter into an Agreement or Agreements or amend existing Agreements with the Sports & Exhibition Authority of Pittsburgh and Allegheny County and/or the Commonwealth of Pennsylvania (acting through various departments or offices)  in order to facilitate dispersal of funding from an RACP Grant, DCED Multi-Modal Grant, PennDOT Multi-Modal Grant, and DCNR C2P2 Grant.

 

Section 3. Funding received by the City from SEA and/or PennDOT under the aforementioned agreements will be deposited into the following respective accounts:

Section 4. If Project funds remain after the satisfaction of all costs arising from the Project, the City is to reimburse the SEA an amount not-to-exceed one million three hundred thousand dollars ($1,300,000). Any such reimbursement shall be authorized by City Council by future legislation.  

 

Section 5. If funding is available for long-term maintenance costs of the Project, such funds shall be authorized for deposit into revenue account 11101.420000.43.43141.
