Resolution requesting the approval of an inter-municipal transfer of a restaurant liquor license, License No. R-3404, from RIMMA, Inc t/a DeMartino's 1100 Washington Avenue, Carnegie, PA 15106 to Thomas C. Hales, 2304 Eldridge Street, Pittsburgh, PA 15217 for Café Asia, LLC, located at 5833 Forbes Avenue, Pittsburgh, PA 15217, pursuant to amended Pennsylvania Liquor Code, §4-461.

Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1.  The Council of the City of Pittsburgh hereby endorses the request for approval of an inter-municipal transfer of a restaurant liquor license, License No. R-3404 from RIMMA, Inc t/a DeMartino's 1100 Washington Avenue, Carnegie, PA 15160 to Thomas C. Hales, 2304 Eldridge Street, Pittsburgh, PA 15217 for Café Asia, LLC, located at 5833 Forbes Avenue, Pittsburgh, PA 15217, pursuant to amended Pennsylvania Liquor Code, §4-461.

SECTION 2.  Request for Approval

Thomas C. Hales, which has a mailing address of 2304 Elridge Street, Pittsburgh, PA 15217, submitted a request for approval of an inter-municipal transfer of a restaurant liquor license, License No. R-3404, which is currently registered to RIMMA, Inc t/a DeMartino's, 1100 Washington Avenue, Carnegie, PA 15160, desires to place a restaurant liquor license into a premises known and numbered as Café's Asia, LLC, 5833 Forbes Avenue Pittsburgh, PA 15217. The proposed interior of the premises is the restaurant will occupy the basement and first floor.

SECTION 3.  Public Hearing

                     City Council shall set a date for Public Hearing for the purpose of receiving comments and recommendations of interested individuals residing in the City of Pittsburgh concerning Thomas C. Hales's intent to the above liquor license.

SECTION 4.  Approval or Denial of Request

                     After the Public Hearing which was held Monday, April 26, 2004 and within 45 days of the introduction of this Resolution, City Council shall render a decision to approve or disapprove of Thomas C. Hales's request for inter-municipal transfer of a restaurant liquor license.  City Council must approve Thomas C. Hales's request unless it finds that approval would adversely affect the welfare, health, peace and morals of the City of Pittsburgh or its residents.

PURSUANT TO 47 P.S. Sec. 4-461 (b.3) -- MAYOR'S SIGNATURE NOT REQUIRED.
