Title
Resolution vacating a portion of Union Place (former North Diamond Street, East), Hydro Way, and East Erie Street in the 22nd Ward, 1st Council District of the City of Pittsburgh.

WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of Union Place (formerly North Diamond Street), East, Hydro Way, and East Erie Street in the 22nd Ward, 1st Council District of the City of Pittsburgh, have petitioned the council of the City of Pittsburgh to enact a resolution for the vacation of same, and
WHEREAS, said petition contains inter-alia, an indemnification of the city from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by and persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. That Union Place, Hydro Way, and East Erie Street situate in the 22nd Ward, City of Pittsburgh, Allegheny County, Pennsylvania, more particularly bound and described as follows:
Beginning at the intersection of former North Diamond Street East (Union Place-name change per Ordinance No. 34 of 1969) and former Union Avenue (Union Place-name change per Ordinance No. 34 of 1969), thence along the northerly line of former North Diamond Street East (Union Place) S 76° 03'53” W 112.00 feet to the easterly line of Hydro Way; thence along easterly line of Hydro Way N 13° 59' 52” W 186.95 feet to the southerly line of East Erie Street; thence by southerly line of East Erie Street N 76° 02' 27” E 112.00 feet to westerly line of former Union Avenue (Union Place); thence along westerly line of said former Union Avenue (Union Place) N 13° 59' 52” W 28.00 feet to a point on the northerly line of East Erie Street; thence along northerly line of said East Erie Street S 76° 02' 27” W 135.75 feet to the westerly line of Hydro Way; thence along Westerly line of said Hydro Way S 13° 59' 52” E 242.94 feet to a point on the southerly line of former North Diamond Street East (Union Place); thence by said southerly line of former North Diamond Street East (Union Place) 135.75 feet to a point on the Westerly line of former Union Avenue (Union Place); thence by westerly line of said former Union Avenue (Union Place) N 13° 59' 52” W 28.00 feet to the point of beginning, and also reserving the right of easement of all 15” sewer lines and all 6” water lines located therein, in the 22nd Ward, 1st Council District of the City of Pittsburgh as described above shall be and the same is hereby vacated.
Section 2. This resolution, however, shall not take effect or be of any force or validity unless owners of all the property fronting or abutting on Union Place (former North Diamond Street, East), Hydro Way, and East Erie Street, as vacated by this resolution, shall, within sixty days after the effective date of this resolution, pay into the Treasury of the City of Pittsburgh the sum of $18,000.00 use of the City of Pittsburgh.
