Title

Ordinance repealing the City of Pittsburgh Code Section 503.19 Traffic and renumbering City Code Sections 503.20 and 503.21 to new City Code Sections 503.19 and 503.20, respectively.

 

Body

WHEREAS, the Supreme Court of Pennsylvania issued an Order dated November 29, 2004, which reorganized the effectively abolished the Pittsburgh Magistrates Court/Pittsburgh Traffic Court.

 

WHEREAS, the Order established an administrative judicial unit that is now referred to as the Pittsburgh Municipal Court, said court being part of the Unified Court System of the Commonwealth of Pennsylvania.

 

WHEREAS, the City of Pittsburgh no longer has the authority to maintain a City Magistrates Court/Traffic Court

 

WHEREAS, it is now necessary to repeal City Code Section 503.19, as the City of Pittsburgh Traffic Court is no longer in existence.

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.  That City Code Section 503.19, Traffic Court is hereby repealed in its entirety and City Code Sections 503.20 and 503.21 are renumbered new 503.19 and 503.20, respectively.

 

503.19 Traffic Court

 

All Police Officers, parking patrol persons and agents designated by the City Treasurer or Superintendent of Police are authorized to make changes and bring information against persons, charged with violations of this Traffic Title or the Commonwealth Vehicle Code, before the Traffic Court Magistrate designated by the city. 

 

503.19                     [503.20] Penalty

(a)                     Whoever violates or fails to comply with any provision f this Chapter where another penalty is not otherwise provided shall be fined three hundred dollars ($300.00) and costs, and in default of payment thereof shall be imprisoned for not more than three (3) days.

(b)                     Whoever violates or fails to comply with §§ 503.05 or 503.06 shall be fined fifty

dollars ($50.00) and costs, and in default of such payment thereof shall be imprisoned for not more than ten (10) days.

502.20 [519.21] Use of Speed Timing Device

In determining the rate of speed of any vehicle, all police officers are hereby authorized to use any mechanical or electrical speed timing device which has been approved by the Pennsylvania Department of Transportation, including, but not limited to the Visual Average Speed Computer and Recorder (VASCAR) device.
