Requesting the approval of an inter-municipal transfer of a restaurant liquor license, License No. R-13097, from Paula Jackson t/a Sonny J's , 400 Talbot Avenue, Braddock, PA 15104-1903 to Whitty Restaurant Group, Inc., for Pittsburgh The Original Fish Market, located in the Westin Hotel 1000 Penn Avenue, Pittsburgh, PA 15222 pursuant to amended Pennsylvania Liquor Code, §4-461.

Be it resolved by the Council of the City of Pittbsurgh as follows:

Section 1.  The Council of the City of Pittsburgh hereby endorses the request for approval of an inter-municipal transfer of a restaurant liquor license, License No. R-13097, from Paula Jackson t/a Sonny J's , 400 Talbot Avenue, Braddock, PA 15104-1903 to Whitty Restaurant Group, Inc for Pittsburgh The Original Fish Market located in the Westin Hotel, 1000 Penn Avenue, Pittsburgh, PA 15222, pursuant to amended Pennsylvania Liquor Code, §4-461.

SECTION 2.  Request for Approval

Whitty Restaurant Group, Inc , which has a mailing address of 1000 Penn Avenue, Pittsburgh, PA 15222, submitted a request for approval of an inter-municipal transfer of a restaurant liquor license, License No.R13097 , which is currently registered to Paula Jackson t/a Sonny J's, 400 Talbot Avenue, Braddock, PA 15104-1903, desires to place a restaurant liquor license into a premises to be known as Pittsburgh The Original Fish Market, 1000 Penn Avenue, Pittsburgh, PA 15222.  The proposed interior of the premises will be containing approximately 7,605 square feet area of the first floor said address.

SECTION 3.  Public Hearing

                     City Council shall set a date for Public Hearing for the purpose of receiving comments and recommendations of interested individuals residing in the City of Pittsburgh concerning the inter-municipal transfer of a restaurant liquor license toWhitty Restaurant Group, Inc, for Pittsburgh The Original Fish Market located in the Westin Hotel, 1000 Penn Avenue, Pittsburgh, PA 15222.

SECTION 4.  Approval or Denial of Request

                     After the Public Hearing and within 45 days of the introduction of this Resolution, City Council shall render a decision to approve or disapprove of Whitty Restaurant Group, Inc, request for inter-municipal transfer of a restaurant liquor license.  City Council must approve Whitty Restaurant Group Inc.'s request unless it finds that approval would adversely affect the welfare, health, peace and morals of the City of Pittsburgh or its residents.

Pursuant to 47P.S. Sec. 4-461 (b.3.) Mayor's signature not required.
