Resolution vacating a portion of Leath Way in the 14th, Ward, 5th Council District of the City of Pittsburgh.

Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.      
 
WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of Leath Way in the 14th Ward, 5th Council District of the City of Pittsburgh, have petitioned the council of the City of Pittsburgh to enact a resolution for the vacation of same, and
 
WHEREAS, said petition contains inter-alia, an indemnification of the city from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by and persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore
 
That vacating a portion of Leath Way, 10' wide, beginning at a point at the NW corner of Lot No. 1 in the Covode Place Plan of Lots P.B.V. 33 p. 114; thence in a southerly direction S 10° 54' W, 10.46 feet to the true place of beginning: thence continuing S 10° 54' West a distance of 130.43' to a point at the corner of Lot No. 1 in said plan; thence S 83° 30', W 10.46' to a point on the centerline of Leath Way; thence along said centerline N 10° 54', 130.43' to a point; thence N 83° 30', E 10.46 ' to the true place of the beginning, containing 1,302 square feet, and also reserving the right of easement of a 15" and 21" sewer line and a 6" water line located therein, in the 14th Ward, 5th Council District of the City of Pittsburgh as described above, shall be and the same is herby vacated.
