Title
Resolution authorizing the Mayor and/or the Director of the Department of Finance to execute a Declaration of Covenants to document the City's responsibility to maintain improvements in Allegheny Commons Park.
Body
Whereas, the City is the owner of Allegheny Commons Park (the "Park"); and
Whereas, the Northside Leadership Conference ("NLC") has received a grant from the Pennsylvania Historical and Museum Commission in the amount of Eighty-Five Thousand Dollars $85,000.00 to restore the pathways in the Northeast Commons of the Park; and
Whereas, the NLC has executed a Project and License Agreement with the City to undertake such planned improvements; and
Whereas, the PHMC requires property owners benefitting from such grants to execute a Declaration of Covenants agreeing to assume responsibility for the costs of maintenance, repair, and administration of such improvements for a period of fifteen (15) years.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Mayor and/or the Director of the Department of Finance are hereby authorized to execute a Declaration of Covenants to document the City's responsibility to maintain planned improvements to the pathways in the Northeast Commons of Allegheny Commons Park. The form and substance of the Declaration of Covenants shall be approved by the City Solicitor.
