Resolution requesting the approval of an inter-municipal transfer of a restaurant liquor license, License No. R-8768, from A & L Russano, Inc., 3324 Babcock Boulevard, Pittsburgh, Pennsylvania 15237, to a location in the Strip District, 103 Twenty-first Street, Pittsburgh, Pennsylvania, 15222, pursuant to amended Pennsylvania Liquor Code,
§4-461.

Body
Whereas, in February of 2001, the Pennsylvania State Legislature amended 47 Pa.C.S.A. §4-461, to allow for the transfer of liquor licenses between municipalities within the same county; and

Whereas, pursuant to 47 Pa.C.S.A. §4-461, a request for an inter-municipal transfer must be approved by the governing body of the receiving municipality when the total number of existing restaurant and eating place retail dispenser licenses exceed one license per three thousand inhabitants; and

Whereas, the Liquor Control Board has determined that the City of Pittsburgh does exceed the one license per three thousand inhabitants, as does approximately ninety percent (90%) of the municipalities in the State of Pennsylvania; and

Whereas, the amendment to the Liquor Code requires City Council, prior to approving or disapproving the requested transfer, to hold a Public Hearing for the purpose of receiving comments and recommendations of interested individuals residing within the City of Pittsburgh concerning the requested transfer; and

Whereas, City Council must, as prescribed by Section §4-461, approve or disapprove the requested transfer within 45 days of the introduction of the Resolution; and

Whereas, City Council, in its adjudicatory capacity, must approve the requested transfer, unless it finds that doing so would adversely affect the welfare, health, peace and morals of the City of Pittsburgh or its residents; and
